NCLAT directs Google to deposit 10% of Rs 1,337.76 crore penalty by CCI

The National Company Law Appellate Tribunal (NCLAT) agreed to hear Google’s appeal against the Competition Commission of India on Wednesday but directed the tech giant to deposit 10% of the Rs 1,337.76 crore penalty imposed by CCI in October last year.

The next hearing is scheduled for February 13 on the issue of staying the penalty levied by CCI in October and the final hearing is expected on April 3.

NCLAT also refused to pass any orders on the application filed by MapMyIndia and others.

ET reported on January 3 that Sources said when Google mentioned its appeal before the NCLAT for early listing on Tuesday,
OSLabs Technology (India) Private Limited and MapmyIndia also intimated the NCLAT they proposed to file impleadment applications and requested for listing of the same along with Google’s appeal as they were aggrieved by the anti- competitive actions of Google.

On October 20, the
competition watchdog fined Google Rs 1,337.76 crore for abusing its control over certain markets with regard to Android mobile devices. The commission also ordered the company to stop engaging in a number of unfair commercial practices.

Five days later, on October 25,
the anti-trust regulator imposed a penalty of Rs 936.44 crore on Google for abusing its dominant position with respect to its Play Store policies. The commission has also issued a cease-and-desist order in which the regulator prescribed eight corrective measures that Google Play needs to implement to correct the anti-competitive practices.
