Delhi HC refuses to stay release of Hansal Mehta’s ‘Faraaz’ – Times of India

On Thursday, the Delhi High Court refused to stay the release of Hansal Mehta’s film, “Faraaz”. The film is scheduled to be released at theatres on Friday and the HC directed that the producers shall scrupulously adhere to the disclaimer that the movie is inspired by the 2016 Dhaka terror attack, but there are elements in the film that are purely a work of fiction.The mothers of two victims of the Holey Artisan terrorist attack in Dhaka in Bangladesh had objected to the release of the film approached the High Court seeking injunction on the movie on the ground of invasion of privacy.
“You want some editorial control over the film. Sorry, we cannot help you. We see nothing unfounded with this disclaimer,” the court said.
The Bench also noted the submission by the producers’ counsel that no picture or image of the petitioners’ daughters features in the movie.
While the petitioners had argued that the characters in the film have names that sounds similar to theirs and those of their deceased daughters, and that the movie shows real footage of the incident, but Justice Mridul pointed out that no one remembers the names after six years, and that a fictional movie can be based on true events.
The disclaimer reads,”This film is inspired by the attack that took place in Holey Artisan Bakery, in Dhaka, Bangladesh on 01st July, 2016. Elements contained in this film are pure works of fiction. It is not a documentary and does not claim to accurately reflect those incidents that may have occurred on that dark and horrific night. Certain characters, institutions and events in the film are composites/dramatized/fictional and have been used for cinematic reasons and for dramatizing the performances portrayed in the film. The makers have taken creative liberty in dramatizing/ fictionalizing events show in the film. The produce(s)/ director/writers do not endorse, warrant. Present or make any claim pertaining to the accuracy or historical correctness of any events) and/or incidents shown in the film. The makers fully acknowledge and respect other perspectives and viewpoints with regards to the subject matter of this film. No identification of any actual persons, places, buildings and products is intended or should be inferred.”
The filmmakers’ counsel told the court that the film prints have been distributed and tickets have been sold.
