Centre approves draft Data Protection Bill, to be tabled during Monsoon session
The Centre approved a draft of the Digital Personal Data Protection Bill on Wednesday, effectively paving the way for India’s first such privacy law. The proposed legislation is likely to be tabled during the upcoming monsoon session of Parliament. The Centre had earlier told the Supreme Court that the new bill was ready and would be introduced in upcoming session.
The proposed legislation stipulates consent before collecting personal data and provides for stiff penalties of as much as ₹500 crore on persons and companies that fail to prevent data breaches including accidental disclosures, sharing, altering or destroying personal data.
The Narendra Modi-led government had approved the draft of Digital Personal Data Protection (DPDP) Bill 2023.
First introduced in December 2019, the Personal Data Protection Bill had been withdrawn in August 2022 over feedback from stakeholders and various agencies. The government published a new draft Bill in November last year – titled the Digital Personal Data Protection Bill 2022 – and initiated a public consultation.
21,666 comments were received from the public and a series of consultations were held with 46 sector organisations, associations and industry bodies. Comments were also received from 38 government ministries and departments.
