A five-judge Supreme Court Constitution bench upheld 10% EWS reservation among general category. Three judges voted for the Act while two passed a dissenting judgment on the 103rd Amendment Act 2019 that provides reservation to financially weaker section in higher education and public employment. The petitioners had submitted before the SC that providing reservation on the basis of economic criteria breaches the equality code.The 7-day marathon hearing had former Attorney General K.K. Venugopal and Solicitor General Tushar Mehta defend the EWS quota against a battery of senior lawyers who argued for the petitioners.
