Supreme Court stays Kerala High Court bail condition that prohibited playing ‘Varaha Roopam’ song in Rishab Shetty’s ‘Kantara’ – Times of India
The Supreme Court in the order stated, “Petitioner shall present before the Investigating Officer on 12th and 13th February. In the event he is arrested, he shall be released on bail forthwith subject to conditions on the trial court. We issue a stay on Condition 5.”
The song ‘Varaha Roopam’ became a huge controversy and has been in the news last year after the copyright holder ‘Thaikkudam Bridge’ the creator of another song called ‘Navarasam’ that was released over 5 years ago moved suit against the makers of ‘Kantara’.
The anticipatory bail to Rishab Shetty and the producer of ‘Kantara’ was granted by Justice A Badharudeen of the Kerala High Court with a condition stating that “the petitioners shall not exhibit the film `Kantara’ along with the music `Varaha Roopam’ in the film till an interim order or final order after addressing infringement of copyright in this matter will be passed by a competent civil court”.
They then moved the top court against the same. Rishab Shetty and the producer are termed as accused in a (first information report) FIR registered to allege the commission of the offense punishable under Section 63 of the Copyright Act by using the music of Navarasam in Varaha Roopam.
